For the first time ever, a January 6 defendant has managed to beat some of the false charges against him in a Washington, DC court. James Grant is a law student and was charged with nine counts related to protesting the stolen 2020 election at the US Capitol. Grant was found not guilty on four of the nine charges, making him the first and ONLY January 6er who was not fully convicted on all charges against him. Grant is hopeful that he will be able to beat additional charges against him.
The Washington, DC court system that has been handling all January 6 cases is so corrupt that it has been impossible for any defendants to get a fair trial there. The jury pool in DC voted 96% for Joe Biden in 2020, and many of them probably believe that January 6 was a real insurrection (even though no defendant has ever been charged with insurrection). They probably feel like they’re saving the country from dangerous white supremacists every time they send someone to prison for years for misdemeanor trespassing.
The nasty and corrupt US Attorneys in DC pulled the same dirty trick on James Grant that they’ve used on many other defendants. They initially charged him with two misdemeanors—the infamous Enron document-shedding statute USC 1512(c) and parading or picketing in the Capitol. Those didn’t sound particularly serious, so Grant agreed to take a plea deal to avoid any jail time.
As soon as he agreed to plead guilty, the US Attorneys turned around and slapped him with seven additional, much more serious charges. One of the charges was the attempted murder of a police officer with a deadly weapon! Grant suddenly went from facing probation and time served for a couple of dopey misdemeanors to more than 40 years in prison as a violent domestic terrorist.
At least one January 6er committed suicide after the US Attorneys pulled this stunt on him because he felt that it was hopeless to fight against the charges and he’d be spending decades in prison.
Grant has spent three years in pre-trial detention awaiting his day in court. Three years without a trial in that nasty, disgusting DC jail where the guards have been abusing Trump supporters all this time.
He was found not guilty on the charge of Aggravated Assault with a Deadly Weapon. Federal prosecutors were insistent that he plead guilty to this charge, claiming that he had injured a DC police sergeant named Caroline Edwards. Grant refused to plead guilty to the charge because he knew he had done no such thing. He was completely exonerated of assaulting Sergeant Edwards with a deadly weapon.
Grant was also found not guilty of three additional serious felonies, including Engaging in Physical Violence in a Restricted Building or Grounds with a Deadly or Dangerous Weapon. A necessary element of proving those offenses would have been that James Grant knew that Mike Pence was in the building when the January 6 protest happened. Grant sufficiently proved to the court that he had no way of knowing Mike Pence was there.
By the way, Pence wasn’t there. That has been one of the persistent lies that prosecutors have been using in the January 6 cases to secure longer prison sentences against the defendants. Surveillance footage has revealed that Pence scurried out of the building before the first barricades were breached (probably because his Deep State buddies had warned him that the protest was going to take place). Pence wasn’t even there, but that hasn’t stopped DC prosecutors from securing decades-long sentences against J6ers.
James Grant was found guilty on five of the nine charges against him, but he says he’s confident that he can still beat at least two of the charges on appeal. The Supreme Court is expected to rule on the Enron 1512(c) cases this month, which could impact several hundred January 6ers who have already been convicted. That could also result in half of the charges against Donald Trump in DC being dropped.
While James Grant is still facing a long road of appeals, he’s hopeful that he’s going to beat the rap on at least six of his charges. We should all be happy for him. He’s the first Trump supporter who has managed to beat any of the false and ridiculous charges against him.
