President Joe Biden launched his new gun control campaign in New York City this week, making the upsetting claim that “no amendment is absolute” in reference to Second Amendment gun rights.
“Making sure that people who are not allowed to have a gun, don’t get the gun in the first place,” Biden said, according to the Washington Examiner.
“This doesn’t violate anybody’s Second Amendment right. There’s no violation of the Second Amendment right to talk like there’s no amendment that’s absolute,” he added.
“Remember, when the amendment was passed, they didn’t say anybody can own a gun, any kind of gun, or any kind of weapon,” Biden said.
“You couldn’t buy a cannon when this amendment was passed, and so nobody with the money should be able to buy certain assault weapons, but that’s another issue.”
That last part has been previously debunked. Biden was given four Pinocchios by the Washington Post in 2021 when he first made the claim. He was also given a “False” label from PolitiFact in 2020.
But facts don’t seem to matter to Biden who also claimed the Second Amendment of the Constitution isn’t “absolute.” It is. Amendments of the Constitution can not be overturned by a President’s Executive Order.

Biden also referred to the nation’s most popular handgun as a “weapon of war” during his speech.
“You know, futures cut short by a man with a stolen Glock with 40 rounds,” Biden said in reference to the two New York City police officers who were recently killed in a shooting.
“A magazine with 40 rounds. It’s really a weapon of war,” he added. The wild accusations verged on nonsensical, especially in his words in opposition to the Second Amendment.
Imagine for a moment if Biden had said, “No amendment is absolute,” in regard to any other amendment. For example, the First Amendment that deals with freedom of speech and religion? Americans would be furious, at least those who care about religious freedom and oppose censorship.
What if it had been the 14th Amendment that speaking of providing equal protection under the law to all people? Every American would be furious, as this would speak out against freedoms for Black Americans who at one time were not protected equally under the nation’s laws.
Or what about the 19th Amendment that allows women the legal right to vote? Does Biden want to say that amendment is not absolute?
The argument only works for Biden when he wants to narrowly define which amendment he has in mind. The only amendment he wants to make not absolute is the right to bear arms.
But you don’t get to pick and choose which amendments you want to follow as president. You are sworn to protect the rights of citizens, not change them. Biden has his role confused, which is sadly not the only thing he’s confused about.
Even if he was right (and he’s not), it’s not the outlaws shooting cops who are going to sit at home, watch Biden’s speech and reflect on his words to decide whether they should now start following the law. Biden’s new gun restrictions will instead further make it difficult for law abiding citizens to protect their families from these criminals.
We don’t need to debate the limits of our amendments. Biden needs to protect our laws and stop trying to change them for his own convenience.

As a supporter of the NRA and competition shooting for many years, I have difficulty accepting a 40 round magazine for any purpose than combat and material destruction. 10 rounds seems like a reasonable number of rounds for defense or developing shooting accuracy in competition or leisurely at the range. Patience, self control and firearm safety should be a constant mantra in the mind of anyone who touches a firearm.

Where in there does it say that the government gets to decide what weapons (Arms) Americans are allowed to own and carry (keep and bear)? Biden is correct in saying that no amendment is absolute. But it takes the voice/vote of our citizens to amend any part of our Constitution, to include the amendments themselves.
