Congresswoman Elise Stefanik (R-NY) was the very first elected Member of Congress to endorse Donald Trump for president in 2024. As of Friday, she is also one of the first Members of Congress to take concrete action to try to defend Donald Trump against the out-of-control, one-sided “justice” system that is persecuting him.
Rep. Stefanik filed an ethics complaint against New York Supreme Court Justice Arthur Engoron, whose bizarre courtroom antics in the Letitia James case against Trump have called his sanity into question.
Stefanik filed her lengthy complaint against Engoron with the New York State Commission on Judicial Conduct. She lists 22 instances—with citations—of bizarre and unethical behavior in Engoron’s courtroom and asks that Engoron be recused from this obviously biased case.
For those who are having trouble keeping track, this is the trial in which AG Letitia James accused Donald Trump of defrauding banks that are all willing to continue doing business with him. The banks also never complained about the Trump Organization and were paid back in full and with interest. There’s no victim in the case, but James is suing Trump for $250 million and trying to pull all the businesses licenses so the Trump family can no longer do business in New York, and every Trump Organization employee will be put out of work.
Among the ethics complaints that Stefanik filed against Engoron:
The judge issued a summary judgment against President Trump before the trial had even started. He hadn’t heard a single witness or looked at a single piece of evidence, but basically found Trump guilty and THEN started the trial. Primitive jungle tribes in the Amazon are capable of fairer trials than that.
On the very first day of the trial, Engoron posed and smiled for the cameras like a weirdo.
After Trump won an appellate ruling on the proper statute of limitations, Engoron simply ignored the ruling. For about 80% of the items listed in Letitia James’ complaint against him, the statute of limitations had already expired. Judge Engoron didn’t care. Ivanka Trump shouldn’t have even had to testify in this case, since her work with the Trump Organization was so long ago. Engoron forced her to come in and take the stand anyway.
Stefanik also argues that taking Trump to trial in front of just this judge—who has already declared Trump to be guilty—is a violation of his Seventh Amendment right to a trial by jury. When Trump was on the witness stand, this crazy judge actually told him, “We are not here to listen to what you have to say.”
Judge Dingbat then screamed at Trump’s attorney Alina Habba, “I am not here to hear what he has to say, now SIT DOWN!” He also slammed his hand on the table as he was screaming at Trump’s attorney.
Stefanik notes that Engoron and his staffers are partisan Democrats who have made political donations to Democrat candidates and organizations. Judge Engoron himself has donated to the group Manhattan Democrats, which is a violation of Section 100.5 of New York Code.
Judge’s staffers are not allowed to make more than $500 in political donations in a calendar year. And yet Engoron’s principal clerk Allison Greenfield donated $3,335 to Democrats in 2022 and has donated more than $1,000 to Democrats this year.
When Trump’s attorneys notified the judge that his clerk was in violation of New York law in regard to political donations, the judge imposed a gag order on President Trump and his entire legal staff.
Stefanik also notes that it is an illegal prior restraint against the president’s First Amendment right to freedom of speech for the judge to gag him and his legal staff. In Washington, DC, a panel of three Democrat judges has already issued a stay against Judge Chutkan’s illegal gag order in the January 6 case against Trump. Why does Engoron get to impose all these gag orders, in a case involving much less serious (yet still frivolous) charges?
“Judge Engoron’s bizarre and biased behavior is making New York’s judicial system a laughingstock,” notes Stefanik in her ethics complaint.
This trial is a joke but that doesn’t mean it’s not serious. This judge could find President Trump guilty and order to have the entire Trump family’s business licenses revoked. Trump will ultimately win this on appeal, but the case is such a nothingburger—and the judge’s obvious Trump Derangement Syndrome—that we hope the Commission on Judicial Conduct will shut Engoron down.

I think it’s fair to say that this case should, and quite probably will, be subject to appeal, as it rightly should. We cannot rely upon fairness in New York jurisprudence, it does not exist.
