Democrats, the media, the January 6 Committee and even some federal judges are rejoicing because Attorney General Merrick Garland has finally delivered the goods. Garland has charged 11 members of the Oath Keepers with “seditious conspiracy.” Never mind the fact that the indictment is as flimsy as a counterfeit Arizona ballot. The Democrats are thrilled that they can finally claim with a straight face that someone has been charged with sedition. They’re not going to be happy when these sedition charges are laughed out of court.
The big “catch” in this indictment is Oath Keepers founder Stewart Rhodes. The other ten members of Oath Keepers had all been previously indicted on the usual list of milquetoast charges: Trespassing, briefly interrupting a meeting of the US Senate, parading in the Capitol Building, etc. The fact that Rhodes had not been indicted prior to this has led many to speculate that he is a fed like that Ray Epps guy.
Maybe. Maybe not. Rhodes didn’t carry a gun that day, never punched any cops, didn’t enter the Capitol building, didn’t hurt anyone, didn’t break anything and used the correct amount of change in the parking meter. So, who knows? Maybe the feds knew that it would look like BS if they tried to charge Rhodes with anything, given his model citizen behavior during the protest.
Anyway, this is it. This is the feds’ big white supremacist militia group that tried to overthrow our democracy on January 6. The Oath Keepers, led by Stewart Rhodes, were so intent on waging war against the federal government that they left all of their guns at their hotel rooms across the Potomac in Virginia, so that they would not get in trouble for violating Washington, DC’s draconian gun laws.
The total number of Oath Keepers indicted because of January 6 is now 20. Three of them, including Rhodes, never went inside the building. One group of the remaining 17 Oath Keepers went into the building for about 25 minutes and left after being pepper sprayed by police. A second group entered the building through a different door, encountered a group of police, and turned around and walked back out.
The Department of Justice hilariously asserts that Rhodes and the Oath Keepers coordinated their plans to “attack” the Capitol using an encrypted messaging app. In one of the highly sensitive conversations listed in the indictment, the DOJ says they discussed whether they should coordinate their outfits by wearing khakis or blue jeans.
On the one hand, it doesn’t look like the encrypted messaging app that they used was very encrypted, since the feds have all their communications. And I’ll bet they’re kicking themselves that they didn’t opt to wear the blue jeans, since they are all now facing 20 years in prison for “seditious conspiracy.”
Here’s another big inconsistency in this farce. The Department of Justice is now saying that Stewart Rhodes is so dangerous that he should not be allowed out of jail until after his trial, which probably won’t take place until 2023 now. “Lock him up in solitary confinement like the rest of the insurrectionists!” If Stewart Rhodes is really such a great threat to our democracy, then why did they wait more than a year to charge him with “seditious conspiracy?” Was he less dangerous for the past 12 months than he is now? I’m confused.
Another Oath Keeper, Edward Vallejo, stayed at the hotel in Virginia where the rest of the group left their firearms behind. Vallejo was supposedly “coordinating quick reaction forces” among the Oath Keepers that day and has been arrested as part of the “conspiracy.” And once again – the Oath Keepers never brought a single firearm to DC that day, whether as part of a “quick reaction force” or otherwise.
In Vallejo’s charging documents, the DOJ says that he participated “in a plot to oppose by force the execution of the laws governing the transfer of presidential power in the United States.”
Uh… that’s not a crime, believe it or not. There is not a single statute on the books that says it’s illegal to oppose the transfer of presidential power in the US – even if you oppose it by force. People oppose the transfer of power every time it happens. Go back and look at the violence, looting and arson that took place during Donald Trump’s inauguration. It was far worse than anything that happened on January 6.
And I don’t normally joke about the January 6ers the way I have in discussing the Oath Keepers here. But the charges against them are so flimsy that they will likely be laughed out of court or dismissed with prejudice.
