Approximately 5 seconds after Hunter Biden’s former business partner Devon Archer testified before a House committee this week, Jack Smith dropped more indictments against Donald Trump. For delivering a political speech on the National Mall on January 6, 2021, President Trump is now charged with an anti-KKK law banning highway disguises. This is a death penalty crime, as we noted first last week.
House Republicans have explicit powers that many of them may not realize, which could bring these deadly-serious prosecutions of an innocent man to a halt right now—if only they would use them.
I can’t imagine why you would have watched it, but if you did watch Jack Smith’s press conference on his latest trumped-up Trump charges, you may have noticed how nervous he looks. He should be. Smith understands the stakes here, even if it hasn’t sunk in with the general public yet. Jack Smith has been tasked with carrying out a political assassination by other means.
Even some liberals seem to be waking up to the fact that the Biden regime, Merrick Garland and Jack Smith are pushing the country toward a precipice. Liberal columnist David Brooks at the New York Times wrote a piece about the Trump indictments this week called, “What If We’re the Bad Guys Here?” It is a rare moment of self-reflection from a progressive elite, which is something progressive elites haven’t been willing to do since Trump came down the escalator in June of 2015 and we elected him as a giant middle finger to the progressive elites.
You are the bad guys, David. Trust us on this. Your incessant fussiness and endless investigations of an innocent man have turned him into a hero to the people, and your progressive elitist friends are clueless as to how to stop themselves from continuing down this path.
As for Congress, there are two things they could do to immediately end this witch hunt until after the 2024 election.
First, call Jack Smith in to testify immediately. The DOJ, the FBI and the rest of the intelligence agencies all view themselves as above the law and above congressional oversight. Smith will refuse to appear. Charge him with Contempt of Congress and demand that Merrick Garland throw Smith in jail to compel him to testify.
Merrick Garland will obviously refuse to enforce the Contempt of Congress charge. That gives Republicans even more evidence to impeach Merrick Garland. Impeachment may or may not be upheld in the Senate, but that will throw a wrench into the works of this politicized prosecution of Donald Trump.
The second and more powerful thing that House Republicans could do would be to call President Trump in as a witness. Congress has the ability to immunize a witness from prosecution under 18 USC § 6002. The law states:
“No testimony or other information compelled under the order (or any information directly or indirectly derived from such testimony or other information) may be used against the witness in any criminal case, except a prosecution for perjury, giving a false statement, or otherwise failing to comply with the order.”
The key part of that law in this case is that NO INFORMATION, directly or indirectly gained from President Trump’s testimony can then be used in ANY criminal case against him. Jack Smith’s crazed persecution of President Trump would end the moment that House Republicans immunize President Trump.
